Albert J Nicaud

Albert Nicaud began his career over 35 years ago as house counsel for a property casualty insurer in the litigation division. It was his first job out of law school, and he tried his first case two weeks after he began his career. As house counsel, he defended some of the largest companies in Louisiana in the defense of their property and casualty claims and suits. He also represented auto and homeowner’s insurers and their insureds in the defense of their claims and suits. After Hurricane Katrina, he saw how unfairly many insurers treated our community and began representing Louisiana residents in their hurricane and flood claims. His firm has handled over 2000 hurricane claims since Katrina.

Mr. Nicaud has a strong civil litigation practice where he represents individuals and businesses, both as plaintiffs and defendants, in civil actions. He has a particular focus on construction disputes, claims under the New Home Warranty Act, redhibition claims, suits by and against contractors, subcontractors and material suppliers in claims for defects, claims for nonpayment, and actions under the Private Works Act and Public Works Act. Mr. Nicaud has over 35 years of extensive trial experience, before juries, district judges, administrative law judges, arbitrators, and appellate courts.

Mr. Nicaud represents many corporations and limited liability companies in their litigation against other entities and in disputes among members and shareholders. He also prepares shareholders and operating agreements for shareholders and members of closely held companies. He has prepared and negotiated buy/sell agreements, mergers and acquisitions dissolution actions and numerous other business transactions.

Mr. Nicaud has a limited but focused personal injury practice representing clients injured in automobile and truck accidents, slip and falls and premises liability cases.

Mr. Nicaud prepares and negotiates commercial and residential lease agreements and litigates commercial and residential lease disputes. He has also litigated real estate disputes, boundary disputes, encroachment and acquisitive prescription claims.

Mr. Nicaud has also served as counsel for the Louisiana State Board of Home Inspectors since its inception in 2001 and has either written or assisted in writing much of its laws and administrative rules. He has a vast knowledge of the construction industry and has personally worked in the construction field for many years.

Mr. Nicaud represents Condominium, townhome and homeowner’s associations regarding member disputes, nonpayment and other issues with members, as well as in interpreting and amending their declarations and bylaws.

Mr. Nicaud has an extensive succession practice, handling estates, probate, succession disputes and estate planning. He has years of experience preparing wills, powers of attorney, trusts and living wills.

Mr. Nicaud represents numerous restaurants, event venues, purveyors and other service industry clients. His experience putting himself through college and law school as a waiter, bar tender and bar/restaurant owner has given him a special connection to the industry. He also serves as legal counsel to, as well as a director and executive board member for, the Louisiana Hospitality Foundation, which provides crisis grants and culinary education to hospitality workers.

Mr. Nicaud also co-hosts the weekly radio show “All Things Legal” on WWL 870 AM/ 105.3 FM on Sunday mornings from 8 a.m. – 10 a.m. The show has been a valuable tool to inform people of their legal rights and duties as well as a platform to discuss business and legal issues.
